Constitution and General Rules

? The name of the Class is the Sea View One-Design Dinghy Class (hereinafter called ?the Class?). Its burgee shall be yellow with a brown St. George's Cross. The Class is a one-design racing dinghy Class. The rules, specifications and Authorities granted to the Class Committee are designed to maintain and ensure that the Sea View One-Design Dinghies and their sails are as similar as possible within the tolerances imposed by the materials being used, the age of the Class, the handmade nature of the dinghies, and a desire to keep down the costs. For the purposes of the Racing Rules of Sailing, any Sailing Instructions or Notice of Race, the Class Rules comprise this Constitution, the Specification, the Insurance Requirements and the Scoring Systems.

? The Class shall consist of Owner Members, Associate Owner Members, Ordinary Members and Temporary Members.

? Membership of the Class is open to all, subject to the approval of the Class as represented by its Officers and Committee for the time being, provided that each Owner Member is or becomes a Member of the Sea View Yacht Club, becomes a Temporary Member or is on the waiting list for such membership.

? The Flag Officers of the Sea View Yacht Club shall, during their term of office, be Honorary Members of the Class and shall be entitled to attend any General Meeting of the Class and to vote on all Resolutions, except as provided in General Rule 24.

? An Owner Member is the person paying the annual subscription for that category of membership or the nominated person on whose behalf such payment is made, and as such is responsible for all matters concerning the dinghy owned. An Associate Owner Member is a person nominated by the Owner Member as a part owner. Owner and Associate Owner Members shall be entitled to receive all circulars issued by the Class. Members must advise the Committee of any change in their ownership interests in a dinghy.

? Any Member of the Sea View Yacht Club, not being an Owner or Associate Owner Member of the Class, who enters as a helmsman in an official race and ranks as a Starter, shall be an Ordinary Member of the Class for the remainder of the sailing season. The Committee may also nominate other Ordinary Members.

? Persons authorised by the Officer of the day or of the Class may become Temporary Members for the day and, subject to the observance of the Racing Rules, shall be entitled to helm in Class Races. A Temporary Member shall not be entitled to attend a General Meeting of the Class.

? Management of the Class shall be vested in a Committee consisting of:

The Vice Captain(s) of the Class

The Honorary Secretary

The Honorary Treasurer

The Honorary Class Measurer

A minimum of six elected Members of the Class

The Committee shall be elected at the Annual General Meeting and its members shall hold office for one year. Only members of the Sea View Yacht Club are eligible for election to the Committee. The new Committee shall take office on 1st January following the Annual General Meeting. The quorum for meetings of the Committee shall be four.

? The Committee shall have power to make or amend all Rules, Specifications and instructions and to decide all matters affecting the Class, subject to confirmation at the next Annual General Meeting.

? The Committee shall meet when summoned by the Captain (or Vice Captain when acting in his/her stead) or Honorary Secretary and may delegate specific duties temporarily to any of its members.

? The Captain of the Class shall be responsible for the sailing activities of the Class, in accordance with the Sailing Rules and Instructions, with power to delegate the whole or part of his or her responsibilities at any time to any member of the Committee. He or she shall act as Chairman of the Committee and General Meetings. No Captain of the Class may serve continuously for more than five years.

? The Vice Captain(s) shall act in the absence of the Captain.

? The Honorary Secretary and the Honorary Treasurer respectively shall be responsible for all clerical and financial matters. The Class shall indemnify them in respect of any claim made against them by virtue of their appointments.

? Sea View One-Design Dinghies must be built on Class moulds by a builder approved by the Committee and shall only be admitted to the Class if they conform to Class specifications and measurements, which shall be confirmed by two members of the Committee appointed for that purpose.

? All sails must be made by the Class Sailmaker who shall be appointed by the Committee, for such a period as they may from time to time decide, to provide sails conforming to Class specification and measurements. All new sails must be approved by two members of the Committee (one of whom should be the Class Measurer) appointed for that purpose. Any dispute with regard to the measurement or quality of the sails shall be between the person ordering and the Class Sailmaker. No sail may be re-cut or adjusted from its original manufacture without the written permission of the Class Captain or Class Measurer. All repairs to sails must be approved by the Class Captain or Class Measurer before proceeding and may only be carried out by the approved Class sail repair loft.

? The Class shall be unlimited in number.

? Should for any reason the owner of a Sea View One-Design Dinghy cease to comply with the requirements of General Rule 3 that owner's dinghy shall, on 31st December of the year following such cessation of membership, cease to qualify as a Class Dinghy and shall only be re-admitted to the Class after re-measurement in accordance with General Rule 14 and the payment to the Class of an Entry Fee to be determined by the Committee.

? The rate of subscription for membership for the ensuing year shall be fixed at the Annual General Meeting. The subscription rate for Owner Members shall include cost of insurance of the Dinghy on such terms as the Committee may from time to time decide (see Section D - Insurance.). Subscriptions must be paid before 7th March to ensure that insurance is effected. Subscriptions paid by means of the direct debit scheme established by the Class may be paid in two instalments in accordance with the details of the scheme.

? No Dinghy shall be allowed to take part in any race or rank as a starter until the Owner Member has paid all subscription amounts then due, thereby being fully insured according to SVYC requiments.

? Owner Members who intend laying up their Dinghies for a period of two or more years may retain membership of the Class on payment of the full Owner Member's subscription. During the whole period the Dinghy should be insured against ?in store? risks only by arrangement with the class insurer.

? The Annual General Meeting shall be held during August to elect the Officers of the Class and a minimum of six members of the Committee, to receive the Statement of Accounts and to conduct any other business. Notice of this Meeting shall be given at least three days beforehand on the Class Notice Board. No changes may be made to the constitution and rules of the Class unless included within this Notice of Meeting.

? At the discretion of the Captain, issues likely to be of particular importance to members of the Class may be put to a vote by post (or other suitable method).

? A General Meeting may be called at any time by the Honorary Secretary acting on behalf of the Committee, or at the written request of at least seven members. Such request must be delivered to the Honorary Secretary at least five days before the date of the proposed Meeting if in August or at least 21 days if the request is made in any other month, and must contain notice of any business or proposition which it is proposed to discuss.

? The quorum at any General Meeting shall be fourteen members.

? If, at any General Meeting of the Class, a question affecting Dinghy owners is put to the vote, only Owner Members shall be entitled to vote, either in person or by proxy. Such proxies must be registered with the Honorary Secretary in writing before the commencement of the Meeting. In the case of dispute, the Chair of the Meeting shall decide whether any question or proposition shall be put to the Meeting as a whole or shall be voted on by Owner Members only and their decision shall be final.

? The Accounts shall be made up on 31st December in each year and shall be presented at the Annual General Meeting for adoption. A statement of Accounts shall be available for inspection on the Class website at least three days before the date of the Annual General Meeting.
